Terms of service

1. Scope of Application

These General Terms and Conditions ("GTC") apply to all orders placed via the online shop of Ettel's AG.
They apply to customers in Switzerland, the European Union and other countries to which delivery is offered.
By placing an order, customers agree to these GTC.

3. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer.
By submitting an order, customers make a binding offer to conclude a purchase contract.
The contract is concluded once the order confirmation is sent by e-mail.

4. Prices and Taxes

All prices are stated in the currency indicated in the online shop.
For deliveries outside Switzerland, additional customs duties, import charges, value added tax or other fees may apply. These are to be borne by the customer.
The prices applicable are those in effect at the time of ordering.

5. Payment Terms

Payment is made using the payment methods offered at checkout.
Payment processing is carried out via Shopify Payments and, where applicable, other payment service providers.
Ettel's AG does not store any complete credit card data or sensitive payment data.

6. Delivery

Delivery is made to the address specified by the customer.
Delivery times are non-binding unless expressly confirmed as binding.
Partial deliveries are permissible, provided they are reasonable for the customer.
To the extent permitted by law, risk passes to the customer upon handover of the goods to the carrier.
Mandatory statutory provisions of the consumer's country of residence apply to consumers.

7. Right of Withdrawal (for Consumers)

7.1 Switzerland

There is no statutory right of withdrawal in Switzerland.
The return policy published on the website applies.

7.2 European Union

Consumers residing in the EU have the right to withdraw from the contract within 14 days without giving any reason.
The withdrawal period is 14 days from receipt of the goods.
To exercise the right of withdrawal, a clear statement sent by e-mail to info@ettels.ch is sufficient.
The costs of returning the goods are borne by the buyer, unless otherwise agreed.
Sealed goods which are not suitable for return for reasons of health protection or hygiene are excluded from the right of withdrawal if their seal has been removed after delivery.

8. Warranty

The statutory warranty rights of the country in which the customer has their habitual residence apply, to the extent that mandatory provisions apply.
To the extent permitted by law, warranty claims are fulfilled, at the discretion of Ettel's AG, by repair or replacement delivery.

9. Liability

To the extent permitted by law, the liability of Ettel's AG is limited to intent and gross negligence.
No liability is assumed for indirect damages, consequential damages or loss of profit, to the extent permitted by law.
Mandatory statutory liability provisions remain unaffected.

10. Product Information

The products are intended exclusively for their intended purpose.
Instructions for use must be observed.
Individual results may vary.

11. Data Protection

The separate privacy policy applies.

12. Governing Law

Swiss law applies, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
Mandatory consumer protection provisions of the consumer's country of residence apply to consumers.

13. Place of Jurisdiction

To the extent permitted by law, the place of jurisdiction is the registered office of Ettel's AG in Switzerland.
Mandatory statutory provisions on jurisdiction of the consumer's country of residence apply to consumers.

14. Severability Clause

Should individual provisions of these GTC be or become invalid, in whole or in part, the validity of the remaining provisions shall remain unaffected.
